Terms of Service

These terms and conditions are for the sale of original artworks by the artist Katie Whyte (ABN 72159544310) from the ecommerce platform (Shop) on this website (www.katiewhyte.com.au) which is owned and operated by the artist and sole trader Katie Whyte.

These terms and conditions of sale apply to all transactions performed on this website. By making a purchase through the online shop on this website, customers are confirming that they have read and understood these terms and conditions and expectations of products and delivery methods described below.


Products & Services

Artworks sold through this website are one of a kind, original artworks, not prints or reproductions. The image shown will either be a digital scan or photograph of the artwork. These are presented as accurately as possible although due to the nature of digital imagery, the finish, brightness and colour of items may appear slightly different in person. Additional cropped images may be used.

Please read the descriptions of each product, especially the size and medium of artworks shown on the website. Many mediums used are of a fragile nature and often not waterproof; these include ink, gouache, pencil drawing and pastel. All artworks will be provided in a temporary archival sleeve to protect the front surface during transit. 

All care is taken when handling artworks prior to sale. Due to the handmade nature of the work, it is expected that studio sale items such as drawing, paintings or sketches may have minor markings on the front or back surface not visible in photographs. The artist will indicate if more obvious markings are present in the product's description.

Framing

It is recommended that you frame your artwork as soon as it arrives to protect the quality and longevity of your artwork. Avoid using frames that allow the surface of the artwork to come into contact with the glass. Use a mount board or spacer to create a barrier to prevent the artwork sticking to the glass. Oil paintings should not be framed under glass or they will fog the inside of the glass over time. Artworks are sold unframed unless specifically noted in the description.

The exception to this is original “acrylic paintings on glass”; these are only available in a permanent frame as the frame is a structural element of the artwork and cannot be removed (along with the backing board).


Orders 

Purchases on the ecommerce platform (shop) are not confirmed until:

  • The order is placed with correct contact details and;

  • The payment has been provided in full be either PayPal or Credit Card (Stripe) and;

  • The artwork has been processed by the artist; this includes confirming delivery or collection details with the customer.

Failure to fulfil payment or provide correct contact details may make orders void and items may be returned to the shop for re-sale.



Free Local Collection


The service is only available when the artist is available in Toowoomba and may be limited during holiday times.  At checkout customers can opt to collect their artwork directly from the artist in Toowoomba Queensland. Local collection is free but must be confirmed via email. The collection location and choice of dates will be emailed to the customer within 48 hours of placing their order. Please check your spam folder if you are still awaiting this email after a few days. 


The exact address will only be provided once a mutual time has been agreed on. Customers are not permitted to arrive at the collection address at any other time. Customers may prefer to be contacted via SMS by adding their mobile number in the comments section of their order. Customers must reply to the email/SMS from the artist to confirm your collection. If no reply is made within one week of their purchase, their order may be forfeited. Failure to collect your order without exceptional explanation may lead to your order being refunded and returned to the online shop for resale.



All Shipping

Due to the artist’s regional location, express (same day or next day) deliveries are not available. The best delivery method will be chosen depending on your location, and the size and weight of your parcel which is estimated at Check Out.  Please note, parcels are much larger than your items due to protective packaging. Unframed artwork may arrive in a postpack if it is oversized. Please note, in an effort to reduce waste, recycled materials may be used to package orders.

Customers may be required to retrieve their delivery from nearby courier depots if unavailable at time of delivery. This is outside of the artist's control and is a safety measure to prevent your parcel being  abandoned and potentially stolen. A delayed delivery due to these measures is a better outcome than a missing or stolen delivery from your front door. Original Artworks are one of a kind and are not reproduced if lost in the post.

Customers are responsible for the address details and contact details provided with their order. If incorrect details are provided, deliveries will be delayed and an additional shipping fee may be charged. 


Domestic Shipping

Australia Post is used to ship all small to medium sized artworks and does not include insurance for lost or stolen parcels and gives the postal driver authority to leave your item at the postal address provided. Your new artwork should be delivered to your door and left in a safe place if you are not home. The customer's mobile number will be lodged with their parcel so they will receive updates on the delivery.


All large items to be shipped within Australia, including all framed artworks, will be handled by a professional delivery service, such as Pack-N-Send. This shipping option will not be charged at checkout as the original artwork will need to be quoted for delivery to the customer’s address. A quote will be emailed to you within 7 business days of placing your order. Once agreed, your parcel will not be sent until your shipping invoice is paid.  All unpaid, or partially paid orders that do not meet this deadline will be returned and the order will be forfeited. 


International Shipping

This option is available but will require the artist to prepare a quote for shipping on your behalf after your order is placed. A non-refundable fee of $20.00 AUD will be charged at checkout for all international orders, and an invoice will be sent for your total shipping fees, minus this $20.00 AUD holding fee. Payment is required within 2 weeks of receiving this invoice. International orders will only be shipped once this invoice has been paid in full. All unpaid, or partially paid orders that do not meet this deadline will be returned and the order will be forfeited. 


Intellectual Property

The artist Katie Whyte retains all rights to all artworks displayed and sold through this website www.katiewhyte.com.au All images, details and descriptions of the artworks remains the intellectual property of the artist.​ 

The artist retains the rights to the artwork, including rights to reproduce or distribute images of the artwork, even after the sale is made. Customers and viewers acknowledge that the intellectual property of all physical artworks, digital images and words displayed on this website belong to the artist and no one else is authorised to copy, share, publish or distribute them.
